bullet [New!]***NOTICE:  HM-218E Proposed Rulemaking April 12, 2007***

PHMSA proposes to amend the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180) to revise certain requirements applicable to the manufacture, maintenance, and use of DOT and MC specification cargo tank motor vehicles, DOT specification cylinders and UN pressure receptacles.  These changes affect cylinder testing!!  Read this and comment on it to PHMSA.

***NOTICE:  HM-220F Final Rulemaking August 29, 2006***

This Final Rule, effective Jan. 1, 2007, establishes the requirement for Eddy Current Inspection for 6351 Aluminum Alloy cylinders in SCUBA, SCBA, and Oxygen.  They removed the requirement for CO2, they removed the 40-year Service Life, and they changed the timing requirement to the next retest, instead of within three years.

***NOTICE:  HM-24- Final Rulemaking December 9, 2005***

This Final Rule becomes effective January 9, 2006.  In this rulemaking, the DOT amends the definitions of "Hazmat Employee" and "Hazmat Employer" to include Self-Employed individuals; excludes Cylinder Retesters from the Safety Training requirement of 172.704(a)(3);  replaces the term "Exemption" with "Special Permit", and allows for up to a 4 year renewal for Special Permits.

***NOTICE:  DOT UPDATE October 26, 2005***

In this SNPRM (Supplemental Notice of Proposed Rule Making) the DOT makes changes to the original NPRM of Sept. 10, 2003 (See Below).  In addition to the requirements previously suggested, this SNPRM would set a 40-year service life to all 6351-T6 Aluminum Alloy cylinders, and include CO2 cylinders in the requirment to undergo a combined visual and eddy current examination in order to requalify under §180.205.

bullet***NOTICE:  HM-218 Final Rulemaking June 13, 2005***

In this Final Rule, effective 8/12/2005, PHMSA (formerly RSPA) makes various changes.  Most notable with regards to cylinder requalification are marking of condemned composite cylinders 180.205(i)(2)(ii), and the new section 180.212, which includes repair of damaged threads (only by a manufacturer).

bullet***NOTICE:  HM-220E Proposed Rulemaking March 9, 2005***

PHMSA proposes to amend the Hazardous Materials Regulations (HMR) to adopt standards for the design, construction, maintenance and use of cylinders and multiple-element gas containers (MEGCs) based on the standards contained in the United Nations (UN) Recommendations on the Transport of Dangerous Goods. Aligning the HMR with the UN Recommendations will promote flexibility, permit the use of technological advances for the manufacture of pressure receptacles, provide for a broader selection of pressure receptacles, reduce the need for exemptions, and facilitate international commerce in the transportation of compressed gases.

In this NPRM (Notice of Proposed Rule Making), the DOT proposes to require all 6351-T6 Aluminum Alloy cylinders to undergo a combined visual and eddy current examination in order to requalify under §180.205.

bullet***NOTICE:  ONLY ONE REPEATED TEST ALLOWED***

In this letter of "interpretation", the DOT says you can only repeat the test on a cylinder once.  This is clearly a RULE CHANGE, not an interpretation.  I have written a petition for reconsideration.  Download the original letter from Bill McDonald, the DOT's response, and my rebuttal below:
